These Terms of Service ("Terms") constitute a legally binding agreement made between you ("User," "you") and SustainPassport ("Company," "we," "us"), concerning your access to and use of our platform, website, and DPP issuing services. By registering an account, you acknowledge that you have read, understood, and agree to be bound by these Terms.
SustainPassport operates as an authorized Digital Product Passport (DPP) issuing agency. Our platform allows users to input product data, calculate compliance metrics, and generate GS1-compliant QR codes valid for the EU market. We offer both self-service subscription tiers and full-service agency handling.
Strict Limitation: You are solely responsible for the accuracy, completeness, and legality of all data submitted to the platform. SustainPassport acts strictly as an issuing agency based on the data provided. We do not audit physical products. You indemnify SustainPassport against any EU penalties, customs rejections, or legal actions arising from false, misleading, or incorrect data you submitted.
The platform utilizes automated engines and AI for translation and footprint estimations. These tools are provided for assistance and efficiency. They do not constitute professional legal, environmental, or compliance consulting. The final compliance verification remains the user's responsibility.
By selecting a paid plan, you agree to pay all recurring subscription fees in advance. Fees are billed monthly or annually depending on your selected tier. If you exceed the product limits of your tier, you agree to upgrade your plan or pay overage fees. We reserve the right to change our fees upon reasonable notice.
The platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the service will be error-free, uninterrupted, or that it will meet all EU regulatory nuances specific to your niche industry. Platform calculations are estimates and do not replace official environmental audits.
Maximum Protection: To the maximum extent permitted by law, SustainPassport, its directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption. Our total liability for any claims arising from these Terms shall be limited to the amount you paid to us in the 12 months preceding the claim.
We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms, fail to pay subscription fees, or use the platform to issue fraudulent DPPs.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria and the European Union, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of Bulgaria.
